August 15, 2006— The Judicial Panel on Multidistrict Litigation announced that all ReNu lawsuits filed in federal court will be sent to the Honorable David C. Norton, District of South Carolina, Charleston Division for pre-trial matters. MDLs are created by the courts in order to deal efficiently with mass torts. These cases were consolidated in the District of South Carolina because the worldwide distribution plant for ReNu is located in that state. Several lawsuits have already been filed across the country, alleging injuries resulting from use of ReNu with MoistureLoc. In an SEC report filed in early August, Bausch & Lomb reported it is creating reserves of between $120 million and $150 million to cover legal expenses related to ReNu with MoistureLoc. There is evidence that Bausch & Lomb knew of serious problems with its ReNu product as early as November 2005, but waited until April 2006 to announce the ReNu recall. |

| First Lawsuit Filed Against Bausch & Lomb Over Defective Lens Cleaner | Contact Us | |
April 13, 2006—A New York resident sued Bausch & Lomb, alleging that the company engaged in deceptive marketing practices and failed to disclose to consumers an inherent defect in its ReNu with MoistureLoc lens cleaning solution. ReNu with MoistureLoc is associated with more than 100 suspected cases of fusarium keratitis, a fungal infection that can lead to blindness. The lawsuit does not indicate whether the man has been diagnosed with fusarium keratitis. |
